A B2B intermediary in the sale and purchase of used CNC and metalworking machinery
A marketing and lead generation platform
A trader in machinery (where explicitly agreed)
Machine.nl does not act as manufacturer of the machines offered.
Unless explicitly agreed in writing, Machine.nl does not guarantee ownership, technical condition, or performance of machines listed by third parties.
2. Offers and Quotations
All offers and quotations:
Are non-binding
Are subject to prior sale
Are based on information provided by the seller
Prices:
Are exclusive of VAT unless stated otherwise
Do not include transport, dismantling, loading, insurance, customs, or installation unless explicitly agreed
3. Machine Descriptions and Specifications
Machine descriptions, specifications, hours, condition, tooling, and accessories are provided:
Based on seller information
Without guarantee of completeness or accuracy
All machines are sold “as is, where is”, unless otherwise agreed in writing.
The buyer is responsible for:
Inspecting the machine
Verifying specifications
Performing due diligence
No rights can be derived from website listings, brochures, or advertisements.
4. Role as Intermediary
Where Machine.nl acts as intermediary:
The purchase agreement is concluded between buyer and seller
Machine.nl is not liable for seller non-performance
Machine.nl is not responsible for payment disputes between parties
Commission arrangements may apply.
5. Payment Terms
Unless agreed otherwise:
Full payment must be received before delivery
Payments must be made in cleared funds
Bank charges are borne by the buyer
Failure to pay on time entitles Machine.nl to suspend delivery.
6. Delivery and Risk
Unless otherwise agreed:
Delivery is Ex Works (Incoterms® latest version)
Risk transfers to the buyer at the moment of loading
Machine.nl is not responsible for:
Transport damage
Export restrictions
Customs delays
7. Limitation of Liability
Machine.nl shall not be liable for:
Indirect damages
Consequential damages
Loss of profit
Production downtime
Loss of business
Total liability, if applicable, is limited to the invoice amount of the specific transaction.
Machine.nl is never liable for hidden defects unless explicitly guaranteed in writing.
8. Warranty
Used machines are sold without warranty unless expressly agreed in writing.
Any agreed warranty:
Must be documented
Is limited in scope and duration
Does not cover wear parts
9. Force Majeure
Machine.nl is not liable for delays or non-performance caused by circumstances beyond reasonable control, including:
War
Government restrictions
Transport disruptions
Supplier failure
Energy shortages
10. Intellectual Property
All content on the Website (text, images, branding, logos) is the property of Machine.nl and may not be copied or reproduced without written permission.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of the Netherlands.
Any disputes shall be exclusively submitted to the competent court in the Netherlands.

Machine.nl reserves the right to amend these Terms at any time. Updated versions will be published on the Website.
